In response to queries regarding Pool Certification requirements for B&Bs, the Department has provided the following information which provides information for both shared pools (eg at B&Bs) and non-shared pools:

  • Pool drowning remains one of the leading causes of death in children under the age of five years.
  • Compliance with pool safety laws is critical to protecting this vulnerable age group.
  • Dependent upon the classification of the building and swimming pool, a pool safety certificate is valid for either one year (shared pool) or two years (non-shared pool). These different periods reflect the degree of familiarity with the property and level of risk associated with the use of the property.
  • Regardless the class of building a valid pool safety certificate must exist when entering an accommodation agreement, such as rental agreements, motel or Bed and Breakfast (B&B) stays.
  • A B&B is classified as a Class 3 building.  Shared pools associated with Class 3 buildings require either a Pool Safety Certificate or a Pool Safety Management Plan (PSMP) to be in place at all times.  Certificates and PSMP’s have effect for 1 year from date of issue for all shared pools, unless sooner revoked.
  • It is a pool owner’s responsibility to comply with the pool safety laws, including obtaining a pool safety certificate for a shared pool.
  • To assist owners understand their obligations, the Department has produced a suite of pool safety guidelines.  The guidelines are available at: Pool-safety guidelines.
  • The Queensland Building and Construction Commission (QBCC) website also has information about shared pools, available at: QBCC pool information
  • Additionally, the local Council or building certifier may give owners information about the requirements, during the approval process associated with converting the property to a B&B. Although this is not a mandatory requirement.
